Know all men by these presents that I Aaron Hodges of the County ofSumner State of Tennessee -- knowing the certainty of death and theuncertainty of life have thought proper to make and publish this my lastWill and Testament and do hereby publish in manner and form following towit -- First I wish all my just debts and funal expenses paid -- SecondlyI wish my wife Elizabeth to have during her natural life the use of aSeventy five acre tract of land on which David Bradly now lives and alsoall the plantation lying above a new Cross fence of the place I live on.Also I give her the use of all my negroes durring her natural life and asmuch of my stock of all kinds, as she may choose, also as much of theHouse hold and Kitchen furniture as she wants to have and possess duringher natural life -- Thirdly, I wish all the remainder of my perishableproperty equally divided between my children to wit Holly Hodges, ChirslyHodges, Asa W. Hodges, Martha Hodges, Nancy Brown, Chloe Keen, & MariamHodges And also I wish them to have the remainder of my land which is notleft to my wife to be equally divided between them, and the better toenable them to divide I authorize and empower them any five agreeingthereto to make sale thereof altogether or in parts as may best suit andto make a good sufficient tittle or tittles thereto provide each one ofthe above named Children bind themselves to the sum of five dollars eachannually to my wife for better support and mentinance of her the SaidElizabeth and further before they take possession of the land they are tobuild necessary and comfortable houses for the Said Elizabeth on the saidseventy five acre tract and as soon as they comply with these requistionsthey are to take full possession as above stated and not before. I alsowish my wife Elizabeth Hodges to have one year's support out of the Cropand Stock that I may be possessed of at my death. Fourthly at the deathof my wife I wish my grandson William A. Edwards to have an equal portionof the Stock which she may then possess with said of my other children --that is as much as they draw when they first divide Also I wish to havethe 75 acre tract of land as assigned to her I also wish the land laidoff for his benefit above the new Cross fence and all the negroes andsuch other property as she may have sold on a twelve month's credit andthe money arising from said sale to be divided as follows Martha Hodgesone hundred dollars Holly Hodges one hundred and fifty dollars NancyBrown one dollar Cloe Keen one hundred and fifty dollars -- ChrislyHodges one hundred and fifty dollars Asa W. Hodges one hundred and fiftydollars Mariam Hodges one hundred and fifty dollars and William A.Edwards one hundred and fifty dollars. And said division if there is anyover I wish it equally divided between the said Martha Hodges, HollyHodges, Nancy Brown, Cloe Keen, Christly Hodges, Asa W. Hodges, MiriamHodges and William A. Edwards providing always that the said William A.Edwards lives with my wife or under the control of My Executors, but ifhe is disobedient and refuses to be governed and advised by them then Iwish him cut of with one dollar, and, his part equally divided among allthe rest. It is however understood that the money arising from the saleof the land last mentioned is not under any circumstance any part of itto go to the said Wm A. Edward the 75 acreas being a fair portion of theland for him. Lastly I appoint Chrisly Hodges and Meredith Hodges myexecutors revoking all former wills satisfying and confirming this mylast will and Testament. I Asa W. Hodges of sound mind tho low in health do make and publish thisas my last will & testament hereby revoking & making void all other willsby me at any time made.
First I direct that my funeral expenses and all my just debts be paid assoon after my death as possible out of any money that I may die possessedof or may first come into the hands of my Executrix.
2nd I give and bequeath to my wife Mary Hodges all of the property I maydie possessed of both real and personal during her natural life orwidowhood for her support and the support of those of my children thatshe may keep with her unnamed.
3rd At the death or second marriage of my wife Mary Hodges I wish anequal division of what property may remain in possession in the hands ofmy wife after making those unadvanced equal with ___ those that have beenadvanced. I want my wife to give to those of my children that are withher as I have given to those that left me as they leave her if she has itto spare if not to be made up at her death or second marriage after allare made equal I then wint and equal division between them all if anything left to wit: Susannah E. Hodges, Jeremiah H. Hodges, Marian R.Hodges, C. F. Hodges, Martha C. Hill.
4th I appoint my wife Mary Hodges my Executrix during her natural life orwidowhood. Whereunto I subscribe my name to this my last Will & testamentthis 3rd day of July 1855.
